This article examines how international institutions serve to diffuse human rights norms and create judicial capacity building in post-conflict societies. Specifically, we examine how the International Criminal Tribunal for the former Yugoslavia (ICTY) and the Office of the High Representative have influenced the reform of domestic courts in Bosnia and Herzegovina (BiH). We place these reforms within the broader debate over restructuring the complex system of government in BiH. Since 2005, domestic courts in BiH have had jurisdiction over the following: (...) (1) Cases which were initially under the jurisdiction of the domestic courts but remanded to the ICTY and recently returned to BiH. (2) Cases which originated at the ICTY and have been transferred to the State Court, and (3) new cases which originated and remained in the domestic court system. We find that while human rights norms have been incorporated into the new legal code, the diffusion of these human rights norms has been inadequate because of the lack of judicial capacity building. While some courts in the capital enjoy significant resources, the vast majority of cases will be tried at provincial courts which are under-funded and unable to prosecute the significant number of cases. Moreover, the government structure of BiH has had a decidedly negative impact on the prosecution of these cases. Ultimately, the rule of law requires consistency of approach and funding to protect human rights throughout the state. (shrink)

The Special Court for Sierra Leone and the Extraordinary Chambers for Cambodia represent a departure from the model established by the International Criminal Tribunal for the former Yygoslavia and the International Criminal Tribunal for Rwanda. The SCSL and the ECC have often been referred to as “mixed” or “hybrid” tribunals in which there are significant domestic and international components. The tribunals include a combination of domestic and international judges, utilize domestic and international laws and are administered by a prosecutorial team (...) composed of domestic and international lawyers. Many of these institutional changes have been brought about because of criticisms of the ICTY and the ICTR. The fundamental question of this article is whether these mixed tribunals are a more effective mechanism for providing justice and reconciliation than purely international solutions. This is an important question because both the international community and states are moving in the direction of mixed tribunals. (shrink)

This special issue of Human Rights Review is devoted to an exploration of the current human rights research agendas within the political science discipline. Research on human rights is truly an interdisciplinary quest in which various epistemologies can contribute to each other and form a larger dialogue concerning rights and wrongs. This special issue is devoted to an expansive understanding of the state of research on human rights in the political science discipline. One common theme throughout these contributions is the (...) need for a more nuanced conceptualization of human rights, tools to promote these rights and as social scientists, methodologies employed to study these rights. A second theme is the policy relevance that can be derived from our empirical analysis. This volume demonstrates that the integration of theoretically and normatively rich concepts, empirical social science, and policy relevance do not have to be mutually exclusive when studying human rights. Although the use of truth and reconciliation commissions (TRCs) has grown considerably over the last 3 decades, there is still much that we do not know concerning the choice and the structuring of TRCs. While the literature has focused primarily on the effects of TRCs, we examine the domestic and the international factors influencing the choice of a commission in sub-Saharan Africa from 1974 to 2003 using pooled cross-sectional time series. We find that states which adopted a TRC prior to (...) South Africa were generally repressive centralized regimes which used the truth commission as political cover. However, since South Africa’s TRC, democratizing states have been more likely to adopt a truth commission as a form of transitional justice. (shrink)

This study investigated whether temporal clustering of autobiographical memories around periods of self-development would also occur when imagining future events associated with the self. Participants completed an AM task and future thinking task. In both tasks, memories and future events were cued using participant-generated identity statements . Participants then dated their memories and future events, and finally gave an age at which each identity statement was judged to emerge. Dates of memories and future events were recoded as temporal distance from (...) the identity statement used to cue them. AMs and future events both clustered robustly around periods of self-development, indicating the powerful organisational effect of the self. We suggest that life narrative structures are used to organise future events as well as memories. (shrink)

How do people understand questions about cause and prevent? Some theories propose that people affirm that A causes B if A's occurrence makes a difference to B's occurrence in one way or another. Other theories propose that A causes B if some quantity or symbol gets passed in some way from A to B. The aim of our studies is to compare these theories' ability to explain judgements of causation and prevention. We describe six experiments that compare judgements for causal (...) paths that involve a mechanism, i.e. a continuous process of transmission or exchange from cause to effect, against paths that involve no mechanism yet a change in the cause nevertheless brings about a change in the effect. Our results show that people prefer to attribute cause when a mechanism links cause to effect. In contrast, prevention is sensitive both to the presence of an interruption to a causal mechanism and to a change in the outcome in the absence of a mechanism. In this sense, ‘prevent’ means something different than ‘cause not'. We discuss the implications of our results for existing theories of causation. (shrink)

A novel theoretical framework for an embodied, non-representational approach to language that extends and deepens enactive theory, bridging the gap between sensorimotor skills and language. -/- Linguistic Bodies offers a fully embodied and fully social treatment of human language without positing mental representations. The authors present the first coherent, overarching theory that connects dynamical explanations of action and perception with language. Arguing from the assumption of a deep continuity between life and mind, they show that this continuity extends to language. (...) Expanding and deepening enactive theory, they offer a constitutive account of language and the co-emergent phenomena of personhood, reflexivity, social normativity, and ideality. Language, they argue, is not something we add to a range of existing cognitive capacities but a new way of being embodied. Each of us is a linguistic body in a community of other linguistic bodies. The book describes three distinct yet entangled kinds of human embodiment, organic, sensorimotor, and intersubjective; it traces the emergence of linguistic sensitivities and introduces the novel concept of linguistic bodies; and it explores the implications of living as linguistic bodies in perpetual becoming, applying the concept of linguistic bodies to questions of language acquisition, parenting, autism, grammar, symbol, narrative, and gesture, and to such ethical concerns as microaggression, institutional speech, and pedagogy. It is widely agreed that because animals feel pain we should not make them suffer gratuitously. Some ethical theories go even further: because of the capacities that they possess, animals have the right not to be harmed or killed. These views concern what not to do to animals, but we also face questions about when we should, and should not, assist animals that are hungry or distressed. Should we feed a starving stray kitten? And if so, does this commit us, (...) if we are to be consistent, to feeding wild animals during a hard winter? In this controversial book, Clare Palmer advances a theory that claims, with respect to assisting animals, that what is owed to one is not necessarily owed to all, even if animals share similar psychological capacities. Context, history, and relation can be critical ethical factors. If animals live independently in the wild, their fate is not any of our moral business. Yet if humans create dependent animals, or destroy their habitats, we may have a responsibility to assist them. Such arguments are familiar in human cases-we think that parents have special obligations to their children, for example, or that some groups owe reparations to others. Palmer develops such relational concerns in the context of wild animals, domesticated animals, and urban scavengers, arguing that different contexts can create different moral relationships. This article explores the contributions of women scholars, writers and artists to our understanding of the medieval past. Beginning with a contemporary artists book by Liz Mathews that draws on one of Boethius‘s Latin lyrics from the Consolation of Philosophy as translated by Helen Waddell, it traces a network of medieval women scholars of the nineteenth and twentieth centuries associated with Manchester and the John Rylands Library, such as Alice Margaret Cooke and Mary Bateson. It concludes by examining the translation (...) of the Old English poem, The Wife‘s Lament, by contemporary poet, Eavan Boland. The art of Liz Mathews and poetry of Eavan Boland and the scholarship of women like Alice Cooke, Mary Bateson, Helen Waddell and Eileen Power show that women‘s writing of the past – creative, public, scholarly – forms a strand of an archive of women‘s history that is still being put together. Brexit activists demonstrating outside the British Houses of Parliament were studied in situ to examine their potential for pro-group extreme behavior. This involved activists of two polarized, opposing views; those of Leave and Remain. The research engaged concepts linking the different theoretical perspectives of identity fusion and personal construct psychology. The study measured participants' degree of fusion to their group using a verbal measure. Willingness to undertake extreme acts was assessed in several ways: a measure of willingness to fight for (...) the group, adaptations of the trolley dilemma and questions regarding political violence. Individual construing was examined using repertory grid technique and a semi-structured interview. Results were similar for both Leave and Remain participants. The majority of activists identified as “fused” to their group and, if so, were more likely to undertake hypothetical extreme behavior compared to those who did not identify as “fused.” Repertory grid technique indicated that becoming an activist provided individuals with a clearer and more positive view of themselves. Opposition activists were construed more negatively and extremely than fellow activists, and this construal was associated with an increased willingness to undertake extreme pro-group behavior. This was consistent with the personal construct model of radicalization and was heightened in those who were “fused.” Interview data provided support for the constructivist model and revealed characteristics and concerns of the two groups. Overall, the findings indicate that campaigning organizations contain fused individuals, who are more likely to undertake hypothetical pro-group violence including self-sacrifice. This has broader implications which may be particularly pertinent, given the violent impact of extremist activists around the globe. (shrink)

It’s widely agreed that animal pain matters morally – that we shouldn’t, for instance, starve our animal companions, and that we should provide medical care to sick or injured agricultural animals, and not only because it benefits us to do so. But do we have the same moral responsibilities towards wild animals? Should we feed them if they are starving, and intervene to prevent them from undergoing other forms of suffering, for instance from predation? Using an example that includes both (...) wild and domesticated animals, I outline two contrasting ways of thinking about our moral responsibilities with respect to assisting animals that are apparently in need. One approach is based entirely around animals’ capacities; the other takes context and historical relations into account as well. While not attempting to adjudicate between these views, I’ll point out the advantages and difficulties of both. (shrink)

This paper explores the relationships between Christianity, Englishness, and ideas about the southern English landscape in the writings of the 1930s and 1940s rural commentator, H.J. Massingham. The paper begins by looking in general terms at the conjunction of religious and national identities in the context of national landscapes before moving on to consider in more detail one particular instance of this in the writing of H.J. Massingham. Massingham's understanding of a divine natural order, his construction of a kind of (...) 'divine Englishness' and the way in which he relates this to particular English landscapes is explored. In particular, the paper investigates the natural, social and political power relationships which are embedded in Massingham's work, and suggests that his writing provides an interesting example of one way in which theological reasoning can reflect and reinforce concepts of a naturally ordered national identity. In this paper, I consider the challenge that olfactory experience presents to upholding a representational view of the sense modalities. Given the phenomenology of olfactory experience, it is difficult to see what a representational view of it would be like. Olfaction, then, presents an important challenge for representational theories to overcome. Este artigo pretende mostrar e propor adaptações metodologias centradas na abordagem comunicativa, usando metodologias ativas e as ferramentas TIC para facilitar o ensino-aprendizagem de PLE a deficientes visuais espanhóis. Dada a natureza e índole de caráter introdutório, panorâmico, sistemático e claramente didático deste trabalho, o leitor poderá ter uma compreensão direta e científica do mundo educativo que rodeia o educando deficiente visual.A metodologia utilizada neste trabalho foi quantitativa e qualitativa, a abordagem foi respaldada em bibliografia pertinente e em dados empíricos (...) coletados pela pesquisadora por meio de entrevistas com diretores, coordenadores, docentes. Após as observações e entrevistas foram desenvolvidas e adaptadas algumas metodologias para após serem aplicadas aos alunos dos distintos centros de reabilitação e por último foi feita a análise dos resultados obtidos. In philosophical discussions of the secondary qualities, color has taken center stage. Smells, tastes, sounds, and feels have been treated, by and large, as mere accessories to colors. We are, as it is said, visual creatures. This, at least, has been the working assumption in the philosophy of perception and in those metaphysical discussions about the nature of the secondary qualities. The result has been a scarcity of work on the “other” secondary qualities. In this paper, I take smells and (...) place them front and center. I ask: What are smells? For many philosophers, the view that colors can be explained in purely physicalistic terms has seemed very appealing. In the case of smells, this kind of nonrelational view has seemed much less appealing. Philosophers have been drawn to versions of relationalism—the view that the nature of smells must be explained (at least in part) in terms of the effects they have on perceivers. In this paper, I consider a contemporary argument for this view. I argue that nonrelationalist views of smell have little to fear from this argument. (shrink)

Chris Armstrong argues that attempts at justifying special claims over natural resources generally take one of two forms: arguments from improvement and arguments from attachment. We argue that Armstrong fails to establish that the distinction between natural resources and improved resources has no normative significance. He succeeds only in showing that ‘improvers’ are not necessarily entitled to the full exchange value of the improvement. It can still be argued that the value of natural and improved resources should be distributed on (...) different grounds, but that the value of improvements should be conceived differently. (shrink)

In "What the Nose Doesn't Know", I argue that there are no olfactory illusions. Central to the traditional notions of illusion and hallucination is a notion of object-failure—the failure of an experience to represent particular objects. Because there are no presented objects in the case of olfactory experience, I argue that the traditional ways of categorizing non-veridical experience do not apply to the olfactory case. In their place, I propose a novel notion of non-veridical experience for the olfactory case. In (...) his (2011), Stevenson responds to my claim that there are no olfactory illusions. Although he agrees that it is natural—or at least commonplace—to think there are no olfactory illusions, he argues that there are and provides examples of them, many of which he suggests have analogues in the visual and auditory domains. In this paper, I examine the nature of the disagreement between us. I argue that Stevenson fails to argue against my conclusion that there are no olfactory illusions. (shrink)

Nevertheless, relatively little has been written about the chemical senses—olfaction and gustation. The focus of this paper is olfaction. In this paper, I consider the question: does human olfactory experience represents objects as thus and so? If we take visual experience as the paradigm of how experience can achieve object representation, we might think that the (...) answer to this question is no. I argue that olfactory experience does indeed represent objects—just not in a way that is easily read from the dominant visual case. (shrink)

Much of the philosophical work on perception has focused on vision. Recently, however, philosophers have been turning their attention to the ‘other modalities’. In a pair of entries, I consider olfaction—a sense modality that, along with gustation, has been largely overlooked by philosophers. In this first entry, I consider the challenge that olfactory experience presents to upholding a representational view of the sense modalities. It is common for philosophers to think that visual experience is world‐directed and, in particular, that it (...) is representational. World‐directed views contrast with subjectivist views—views according to which experiences are raw feels or mere sensations. Unlike visual experience, olfactory experience doesn't obviously support a representational view. Indeed, given its phenomenology, a subjectivist view of olfactory experience might seem unavoidable. But it is not. Once we begin to unravel ourselves from the dominant visual model of perception, we see that there is a representational view available that honors the phenomenology of olfactory experience. In turn, we learn that although there are some basic similarities between visual experience and olfactory experience, there are significant differences that prevent us from making easy generalizations from the visual case.
